Sony Consumer Health Data Privacy Policy

This Consumer Health Data privacy policy (“Policy”) describes the collection, use, and disclosure of Consumer Health Data, as defined by applicable laws in Washington and Nevada by Sony Electronics Inc. (“Sony”) through or in connection with our website, mobile apps, and any other product or service that post a valid link to this Policy (collectively, the “Service(s)”). This Policy only applies to Washington and Nevada residents. By accessing, using, or otherwise interacting with any part of the Service, you consent to this Policy and any additional policies and terms you may agree to which govern your use of the Service. This Policy supplements Sony’s Privacy Policy . This Policy will govern in case of any conflicts between this Policy and Sony’s Privacy Policy about how applicable Consumer Health Data may be handled. Consumer Health Data We May Collect

Sony collects, uses, and discloses Consumer Health Data as needed to provide you with the products or services that you request, with your consent, or as otherwise permitted by applicable law.

The Consumer Health Data we may collect includes information about your health-related conditions (such as a hearing condition). We may also collect identifiers (such as your name, cookies, online identifiers, and IP address), contact information (such as your email, phone number, or address), audio information, information regarding your purchase of a health-related product, and inferences drawn from such personal information.

Note that our affiliate Sony Corporation may also collect Consumer Health Data, such as via the Hearing Control app. Please see Hearing Control Privacy Policy for more information regarding Sony Corporation’s health data privacy practices.

Sources of Collection of Consumer Health Data

We collect Consumer Health Data directly from you when you visit our website to view health-related products, or through our service providers, such as our vendor Shoebox, that provides hearing evaluation test on the Service. We may also collect Consumer Health Data directly from you, such as when you contact customer service for assistance with a health-related product or when you otherwise choose to disclose Consumer Health Data to us or make such information publicly available, such as by providing responses to questionnaires or surveys or participating in one of our Community Forums. We may also infer or derive Consumer Health Data by analyzing other data you provide to us directly.

Purpose for Collection and Use

We collect Consumer Health Data in order to:

  • provide you the Services you request, such as permitting you to utilize the full scope of features available on the health-related products you purchase and personalization of features;
  • provide you customer service and support;
  • troubleshoot our health-related products and the related services;
  • improve our products and our services, including to enhance the Service and your experience with us;
  • provide newsletters and updates about health-related products and services;
  • manage our Community Forums for health-related products;
  • and to conduct other essential business operations that support the provision of the products (such as analyzing our performance, meeting our legal and compliance obligations, and conducting research and development).

Disclosures of Consumer Health Data

We may disclose Consumer Health Data to our contractors, customer support providers, data processors, and other service providers, such as to provide you with hearing evaluations, with our affiliates and business partners, including Sony Corporation, in order to improve our products and services, and otherwise as disclosed to you prior to such disclosure. With your consent, Consumer Health Data, such as information about viewing our health-related products on our website, may be disclosed to our analytics and advertising partners. We may also disclose Consumer Health Data (i) in connection with a merger, acquisition, bankruptcy, or similar transition of assets to a third party, (ii) as needed to prevent, detect, protect against, or respond to security incidents, identity theft, fraud, harassment, malicious or deceptive activities, or (iii) to investigate report, or prosecute those responsible for any action that is illegal under applicable law.

Your Privacy Rights

Subject to certain exceptions, you may have the right to exercise the following rights:

Note that we may deny your request if we are not able to authenticate your identity or locate your Consumer Health Data in our systems. We may also request additional information from you if necessary to authenticate your request.

Changes to this Policy

We reserve the right to change this Policy at any time and any changes will become effective immediately upon posting on the Service, unless otherwise stated. We may also provide notice to you in other ways, such as through contact information you have provided. Your continued use of the Service on or after the posted effective date will constitute acceptance of, and agreement to be bound by, those changes to the extent allowed by applicable law.
